Cancellation

Should the function be cancelled or postponed:

  1. After signature of contract and within 60 days prior to the date of the function, the full deposit amount will be retained to cover the cost of room rental.
  2. Should the Wedding/function be cancelled or postponed within 7 days of the date of the Wedding/function, the balance of estimated cost will become payable to The Willows Country Lodge to cover the cost of room rental, food already purchased in and loss of potential income.
  3. Should your reservation be made within two months prior to the start of the function, the function will be deemed confirmed upon signature of contract and all deposits and cancellation fees due, will become payable to The Willows Country Lodge in the event of the Wedding/function not happening.
  4. Should your function be cancelled in excess of 60 days prior to the start of your function, any deposits made will be duly refunded.

Billing

All financial documents and correspondence will be forwarded to the given Fax number or Email address or preferably given personally. Original invoices will be given personally or forwarded via email and if requested it can be faxed through. Account bar details can only be made available the day after completion of your Wedding/function. Please advise all relevant signatories at the function accordingly.

Should we not receive the signed copy of the terms and conditions, your Wedding/function may be deemed cancelled and your reservation released without written confirmation.

Please note: All prices quoted are current and subject to price changes according to fluctuations in the economy.

General
  1. This reservation shall only be confirmed upon return of this agreement, duly signed by the person/s responsible for payment (forthwith called the customer) or an authorised representative of the customer. Any person signing this agreement on behalf of the customer, warrants that he/she is duly authorised to do so and undertakes personal liability in the event of lack of authority.
  2. All correspondence, changes and amendments of confirmation details between The Willows Country Lodge and the customeris to be directed in writing. Final confirmation of all details of the event must be made available to The Willows Country Lodge one week prior to the proposed date of the Wedding/function, in order to guarantee compliance.
  3. Final numbers must be confirmed in writing 72 hours before the function. On this figure, the Lodge will cater and charge accordingly. In the event of your numbers increasing or decreasing by more than 10% of the original figure (as per the booking confirmation letter), the Lodge must be advised in writing no later than 09h00 am 7 (seven) days prior to the date of the function - same where the function is on a Monday; in which event written confirmation must be delivered no later than 09h00 am on the previous Friday.
  4. All correspondence generated by The Willows Country Lodge and disseminated to the customer via electronic media, shall be deemed computer generated documents and are valid without signature.
  5. The venue shall be used strictly for the purposes for which it has been booked and for no other purpose without the prior written consent of The Willows Country Lodge.
  6. In the event of the venue being booked for a specific number of persons, this number may not be exceeded under any circumstances without prior written consent from The Willows Country Lodge.
  7. The customerwarrants that the function will not attract negative publicity of The Willows Country Lodge or in any way detract from its prestige and status as a Luxury Lodge of Greater Gauteng Area.
  8. The customer shall be liable for all damages to moveable and fixed Lodge property, including stains and burns to carpets and linen, due to loss, theft or injury, rising directly or indirectly from the hire of the venue, by the customer, its employees, officials, guests, invitees or members of the public who attend the venue.
  9. Neither the Lodge nor its agents or employees shall be made responsible for any damage or loss which may be caused to any goods of the customer, its employees or invitees brought onto the premises for whatever reason, nor injury or loss of life to the customer or its employees, or invitees howsoever caused. The customer further indemnifies and holds harmless the Lodge against any claim that may be made against the Lodge by any third party relating to the provisions of this clause.
  10. Should your numbers increase by more than 10% within 24 hours of the start of the function, a surcharge of R25.00 per person will be charged, on top of the standard menu price.
  11. The Lodge reserves the right to cancel any bookings forthwith and without liability on its part in the event of any damage to, or the destruction of the allocated rooms, equipment or structures, as a result of fire, vis major, act of God, any shortage of labour and food supplies, strikes, lockouts and industrial unrest or any other causes beyond the control of the Lodge which shall prevent it from performing its obligations in accordance with any booking. In these circumstances every effort will be made to accommodate the booking at another establishment, but cannot be guaranteed.
  12. The customer shall pay full cancellation fees in the event of:
    1. The booking being cancelled as per the conditions stipulated in the attached confirmation agreement
    2. The date of the booking being postponed as per the conditions stipulated in the attached confirmation agreement
    3. The booking being cancelled after the food of the function and equipment and décor has been ordered
    4. The number of guests attending the function decreases to a total monetary amount of less than the standard room hire fee of the venue for that day.
  13. In the event of the function exceeding the time of expiration of hire of the venue, an additional fee of R2000.00 per hour would apply.
  14. All equipment, décor or structures belonging to the customer or his/her suppliers and contractors must be removed directly after the function, unless otherwise agreed by the Lodge. The Willows Country Lodge reserves the right to remove any such goods at its sole discretion without any liability in case of loss, theft or damage, resulting thereof.
  15. All goods belonging to the customer or his/her suppliers and contractors that were stored with the consent of The Willows Country Lodge and are not removed from The Willows Country Lodge within seven days after the function, shall become the property of The Willows Country Lodge and The Willows Country Lodge may dispose thereof as it sees fit, without any liability resulting from this act.
  16. The customer is not entitled to affix, paint or attach any banners, signs or advertising media of any nature to the floor, walls, doors or partitions of the function room/s, without the prior written consent of The Willows Country Lodge.
  17. No food or beverage may be brought into allocated rooms by the customer for consumption on the premises.
  18. The Willows Country Lodge reserves the right of admission to its premises and may have any persons removed in the event of unruly, defamatory, or distasteful behaviour, or whatever other reason may constitute the said person to be damaging to the reputation of The Lodge as a Luxury establishment.
  19.  Any information obtained in any brochure or catalogue (or which accompanies or forms part of any tender made by the Lodge) which shall include prices, is subject to change and the Lodge will not be bound to comply exactly herewith. The Lodge shall not be liable for any inaccuracies in any brochures or information supplied by it, which the customer fails to verify with the Lodge management.
  20. The Lodge shall have the right to cancel this agreement by written notice to the customer in the event of the customer being placed under provisional liquidation, judicial management or sequestration or commits any act of insolvency as defined in the Insolvency Act.
  21. Advice, recommendation or opinions by representatives of the Lodge are given and expressed in good faith and shall not constitute representation of any description, and shall not give rise to any claim against the Lodge or such representatives.
  22. The customer shall pay a deposit as provided for in the confirmation letter. Acceptance of the booking by the Lodge is subject to the condition that the Lodge is provided with proof of deposit payment (cash, internet transfer or bank guaranteed cheque) as stipulated in the confirmation letter.
  23. All prices quoted in the confirmation letter include VAT, unless otherwise specified. All costs quoted in the confirmation letter exclude the cost of beverages and other extras pertaining to and incurred before, during or after the tenure at the hotel.  The latter will be charged to the customers account and the customer accepts responsibility thereof.
  24. The Lodge requires full settlement of the estimated balance of the function 7 (seven) day’s prior to the function. Any balance in excess owed to the customer by The Willows Country Lodge shall be paid out within 14 days after the Wedding/function. Any balance owed to The Willows Country Lodge of additional costs incurred on the day must be settled upon receipt of invoice. Interest will be charged on payments made later than 14 days after the date of the final invoice calculated at The Willows Country Lodge bankers prime overdraft rate plus 3%.
  25. The above terms and conditions apply to all bookings and may not be amended, varied, altered or cancelled save unless same has been reduced to writing and acknowledged by The Willows Country Lodge. No indulgence, latitude, extension of time or any other lenient act or omission on the part of The Willows Country Lodge shall constitute a waiver of its rights hereunder nor stop The Willows Country Lodge from exercising its rights in terms of this agreement.
  26. This agreement shall be governed by the laws of The Republic of South Africa and in the event of the hotel having to institute legal proceedings against the customer in terms of this agreement, then the customer agrees to pay all costs incurred in respect of such an action on a scale as between attorney and own client, including collection of commission. The applicant hereby consents to the jurisdiction of any Magistrates court having jurisdiction over its person.
